Government Tightens Rules for Foreigners Who Will Enter Indonesia during the Emergency PPKM

Minister of Law and Human Rights Yasonna H Laoly officially expanded the restrictions on foreigners allowed to enter Indonesian territory. This expansion is stated in Permenkumham Number 27 of 2021 concerning Restrictions on Foreigners Entering Indonesian Territory During the Enforcement of Restrictions on Emergency Community Activities.

In this regulation, which has been officially effective since July 21, 2021, foreign workers who previously came to Indonesia as part of a national strategic project can no longer enter the country. “In Permenkumham Number 27 of 2021, foreigners who may enter Indonesian territory are only holders of Diplomatic Visas and Service Visas, holders of Diplomatic Stay Permits and Service Stay Permits, holders of Limited Stay Permits and Permanent Stay Permits, foreigners with health and humanitarian purposes, and the crew of the transportation equipment who came with the means of transportation,” said Minister of Law and Human Rights Yasonna.

Thus, foreign workers who previously came as part of a national strategic project or foreigners for reasons of family union can no longer enter Indonesia as regulated in this regulation.
“This expansion of restrictions on foreigners entering Indonesia is carried out in order to suppress the spread of Covid-19,” he said.

The Menkumham Regulation also replaces the Menkumham Regulation Number 26 of 2020 concerning Visas and Stay Permits in the Adaptation Period of New Habits. On the other hand, the Menkumham also mentioned that foreigners who are classified as exceptions to the Permenkumham also need a recommendation from the relevant ministry/institution to enter Indonesia.

“Permenkumham Number 27 of 2021 cannot be separated from good coordination between me and the Minister of Foreign Affairs, Mrs. Retno Marsudi. Minister of Law and Human Rights Number 27 of 2021 cannot be separated from an agreement with the Ministry of Foreign Affairs and its amendments to Permenkumham Number 26 of 2020 also involve staff of the Ministry of Foreign Affairs and the Ministry of Transportation,” said the Minister of Law and Human Rights.

Coordination with related ministries or institutions will also be carried out regarding foreigners who are still allowed to enter Indonesia according to the new rules, for example coordination with the Ministry of Foreign Affairs regarding diplomats who want to enter Indonesia in the context of their duties. as referred to in the Minister of Law and Human Rights Number 27 of 2021 must first obtain a recommendation from the ministry or institution that carries out the Covid-19 handling function,” said the Minister of Law and Human Rights.
